PRESS RELEASE

The Royal Government of Cambodia has again and again reiterated its commitment to maintain friendly and good neighboring relations with all the countries which have the common borders with the Kingdom of Cambodia especially with the Kingdom of Thailand.

            The direction of the Information and Communication Department of the office of the Council of Ministers is endowed with the duty of bringing additional comments to the Aide-Memoire  issued  on April 11 2008 by the Ministry of Foreign Affairs and International Cooperation of the Kingdom of Cambodia and presented to H.E. the Ambassador of the Kingdom of Thailand on April 11, 2008 at 06:00PM in response to the Aide-Memoire of the Ministry of Foreign Affairs of Thailand submitted to the Cambodian Ambassador to the Kingdom of Thailand dated April 10, 2008 and the subsequent Press Release by the Ministry of Foreign Affairs of Thailand on Friday April 11, 2008 at 03:27 PM.

Article V of the 2000 MOU between Cambodia and Thailand refers to the map known to both parties as “DANGREK” map issued by the “Commission de Délimitation entre l’Indo-Chine et le Siam”, submitted by the commission to all parties, following the “Convention of 1904” and the “Treaty of 1907”. In virtue of Article V of the 2000 MOU the Aide-Memoire presented by the Ministry of Foreign Affairs of the Kingdom of Cambodia to H.E. the Ambassador of Thailand explicitly and correctly stated that NO “VIOLATION” has been committed by the Cambodian side. The accusation of a “violation” was ungrounded.

The Cambodian side has maintained the presence of some security guards in order to provide security for the tourists visiting the temple. This is a normal and common practice undertaken by the authorities in any country of the world to ensure safety and security to tourists. This situation and condition must not be viewed by Thai side as deployment or stationing of military and police forces and do not constitute a threat or violation to Thailand sovereignty. The ongoing de-mining activities are part of the national policies of ridding anti-personal mines off the entire territory of Cambodia and these activities actually take place inside Cambodian territory and do not affect the border demarcation zone under any shape and form.

As stated in the Aide-Memoire of the Ministry of Foreign Affairs and International Cooperation of the Kingdom of Cambodia, there are no “overlapping territorial claims” in the zone of Sacred Site of the temple of Preah Vihear, according to the judgment of the International Court of Justice (ICJ) in 1962 and the map of Annex I which is the integral part of the ICJ’s judgment.

Commiqué de Presse

Le Gouvernement Royal du Cambodge a affirmé, à plusieurs reprises, son engagement de maintenir des relations amicales et de bon voisinage avec tous les pays ayant des frontières communes avec le Royaume du Cambodge et, en particulier, avec le Royaume de Thaïlande.

La Direction du Département de  l’Information et de la Communication à la Présidence du Conseil des Ministres se trouve dans l’obligation d’apporter des commentaires additionnels à l’Aide-Mémoire présenté le 11 avril 2008 par le Ministère des Affaires Etrangères et de la Coopération Internationale du Royaume du Cambodge à Son Excellence l’Ambassadeur du Royaume de Thaïlande le même jour à 18 heures, en réponse à l’Aide-Mémoire du Ministère des Affaires Etrangères de Thaïlande présenté à l’Ambassadeur du Royaume du Cambodge auprès du Royaume du Thaïlande le 10 avril 2008 et le Communiqué de Presse publié par le Ministère des Affaires Etrangères du Thaïlande le vendredi 11 avril 2008 à 15h 27mn.

L’Article V du MOU de l’an 2000 entre le Cambodge et la Thaïlande fait référence à la Carte reconnue par les deux Etats sous le nom «DANGREK», carte publiée par «La Commission de Délimitation entre l’Indo-Chine et le Siam» laquelle avait été soumise par la Commission à toutes les parties à la suite de la «Convention de 1904» et du «Traité de 1907». En vertu de l’Article V de ce même MOU de l’an 2000, l’Aide-Mémoire présenté par le Ministère des Affaires Etrangères et de la Coopération Internationale du Royaume du Cambodge à Son Excellence Ambassadeur de Thaïlande a explicitement et à juste titre précisé qu’aucune «VIOLATION» n’a été commise par la partie Cambodgienne. Cette accusation de violation était non fondée.

La partie Cambodgienne a maintenu la présence de gardiens pour assurer la sécurité des touristes qui visitent le temple. Il s’agit d’une pratique normale et commune entreprise par les autorités de tous les pays du monde pour assurer la sauvegarde et la sécurité des touristes. Cette situation ne doit pas être considérée par la Thaïlande comme un déploiement ou un stationnement des forces militaires et de police et elle ne constitue nullement une menace ou une violation de la souveraineté de la Thaïlande. La poursuite des activités de déminage sur le territoire du Cambodge est en conformité avec les objectifs de la politique nationale. De fait ces activités se déroulent à l’intérieur du territoire Cambodgien et n’affecte en aucune manière la zone frontalière.

Comme indiqué dans l’Aide-Mémoire du Ministère des Affaires Etrangères et de la Coopération Internationale du Royaume du Cambodge, Il ne peut y avoir de “overlapping territorial claims” dans la zone du Site Sacré du Temple de Preah Vihear, conformément à l’Arrêt de la Cour Internationale de Justice (CIJ) en 1962 et à la carte de l’annexe I qui fait partie intégrante du Jugement de la CIJ.
